This notification ("Notification") is meant to inform you when applicants apply for the vacant positions offered by:
SC Seatbelt Consulting SRL with its headquarters in Str. Munitiei, no. 5, sector 6, Bucharest, registered in the Trade Register under the number J40/7094/2011, unique registration code RO28607739 ("The Company" / "Seatbelt")
about the processing operations by the Company, as a personal data operator, of your personal data (defined by the General Data Protection Regulation no. 2016/679 - "GDPR").
(1) Processed personal data
Our Company will process the following categories of personal data (hereinafter referred to as "Data"):
(a) Contact and/or identification data, which may include: first and last name; address (home or residence), including previous addresses; phone number (personal and/or work); email (personal and/or work); workplace; series and number of the identification document (ID card / identity card / passport) as well as the information contained in these documents, including the candidate's facial image;
(b) Specific human resources data, which may result from the curriculum vitae and may include: position / profession; education information (including diplomas, studies); nationality / citizenship; date of birth; age; gender; marital status data; religion; mother tongue; other languages spoken; workplace; type of contract; date of employment; seniority; data on union membership; current employer; work history, desired salary, passions/preferences (hobbies).
(2) Data Source
(a) directly from you, e.g. provision or input of your data into our human resources systems, through the application process or through other forms or information you provide us in connection with your employment (job application, employment contract, curriculum vitae, emergency contacts etc.); and
(b) from third parties, including references and other background checks, from former employers and/or labor force recruitment agencies, subject to applicable legal requirements.
(3) The purpose of data processing
The Company collects, processes, and uses Data in any other way for the following purposes: (a) purposes that allow the Company to decide on establishing a work relationship with you; (b) purposes imposed by law and other legal regulations, specifically: Staff recruitment; Establishing human resources policies; Strategic planning of human resources; Exercising the Company's rights in accordance with legal provisions and compliance with legal obligations (including investigations related to these); Purposes related to the general objective of human resources.
There is no automated decision-making process (including profiling) based on your Data.
(4) Data Disclosure
Your Data will be disclosed within the Company only to people in the Human Resources (HR) department or the company's management or other people who need access to your Data ('need to know basis') in order to fulfill their specific duties.
The Company may also present your Data to third parties providing technical and organizational services related to human resources activities or to the Company's legal consultants or other consultants for the purposes mentioned in this Notification. The Company will exercise due diligence in selecting third-party service providers and will require these providers to maintain adequate technical and organizational security measures to protect your Data and to process them in accordance with applicable legal provisions.
The Company may also disclose your Data to authorities, as necessary or permitted by legal provisions, and/or courts.
(5) Data transfer outside the EU or EEA
As a principle, the Company will not transfer Data outside the European Union or the European Economic Area.
(6) Legal basis for data processing
The employer's (future employer's) obligations of the Company and its contractual and/or legal obligations, its legitimate interests and/or the necessity to conclude or execute a contract, in accordance with the legal provisions regarding data confidentiality, constitute the legal grounds for the processing operations of the Data described in this communication.
Our legitimate interests or those of a third party include our requirements to use your Data in litigations, investigations, inquiries by authorities or for other legal or regulatory purposes involving the Company.
(7) Data Security
The Company maintains physical, technical, and organizational security measures to protect Data against destruction, loss, modification, disclosure, restriction, or accidental, illegal or unauthorized access, regardless of where they are processed.
Our security policy regulates how we protect your Data; a copy of this security policy can be obtained from the Human Resources Department.
(8) Processing / storage duration of the Data
We intend to keep your Data accurate and up-to-date. We also strive to keep your Data no longer than is necessary to fulfill the purposes listed in this communication or those imposed by law.
Considering that you are a candidate for a position offered by the Company (without any formal relationship with the Company), your Data provided to the Company (including your CV) will be kept until the end of the recruitment process or, at the latest, until the vacancy is filled. In case the position is filled by another candidate, and you wish us to keep your Personal Data in our database considering a possible future recruitment process for an identical or similar position, your explicit written consent is required, for a maximum period of six (6) months, with the possibility of withdrawing your consent at any time by sending a request to the email address office@seatbelt.ro or to the Company's headquarters in Bucharest, Sector 6, Str. Munitiei no. 5.
Your rights concerning the Data
In accordance with the applicable provisions regarding the Data, we inform you that you have the following rights, which can be exercised by addressing a request in this regard using the contact details indicated in Section (13) below:
(a) The right to access the processed Data;
(b) The right to request the rectification or deletion of the Data;
(c) The right to request the restriction of processing;
(d) The right to object to the processing;
(e) The right not to be subject to an automatic decision, including profiling;
(f) The right to data portability;
(g) The right to file a complaint with the National Supervisory Authority for Personal Data Processing and to address the competent courts.
(9) Data Protection Officer
